1. Acceptance of Terms

By accessing or using Forms.qa ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Forms.qa.

2. Description of Service

Forms.qa provides a web-based platform for creating, publishing, and managing forms and surveys. The Service includes form building tools, submission collection, analytics, AI-assisted form generation, webhooks, API access, and related features as described on our website.

3. User Accounts

You must create an account to use the Service. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring your account information is accurate and current
• Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account. Accounts registered by automated means or under false pretenses are prohibited and will be terminated.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Collect personal data without proper consent or legal basis
• Distribute malware, spam, or harmful content
• Infringe intellectual property rights of others
• Harass, abuse, or harm any person or entity
• Interfere with or disrupt the Service or servers

5. Data Protection and Compliance

You are the data controller for any personal data you collect through forms created on our Service. You are responsible for:

We act as a data processor for data you collect. Our data processing practices are described in our Privacy Policy. We will cooperate with your compliance obligations as required by law.

6. Content and Intellectual Property

You retain all rights to content you create using the Service, including forms, questions, and collected submissions. You grant us a limited license to host, store, and process your content solely to provide the Service.

The Service, including all software, designs, trademarks, and documentation, is owned by Forms.qa and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

7. Subscription and Payment

Some features require a paid subscription. By subscribing, you agree to:

• Pay all fees as described on our pricing page
• Provide accurate and current billing information
• Authorize recurring charges until cancellation
• Understand that fees are non-refundable except as required by law

We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance. You may cancel your subscription at any time through your account settings.

8. Termination

You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms or for any reason with reasonable notice. Upon termination:

• Your access to the Service will cease immediately
• Your data will be retained for 30 days, then permanently deleted
• Outstanding fees remain due and payable
• You may export your data before the 30-day period expires

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMS.QA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold Forms.qa harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or any law.

12. Governing Law and Disputes

These Terms are governed by the laws of Qatar. Any disputes shall be resolved through binding arbitration in Doha, Qatar, except that either party may seek injunctive relief in court. You waive any right to a jury trial or class action.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance. If you do not agree to changes, you must stop using the Service.

14. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.
• Severability: If any provision is unenforceable, the remainder remains in effect.
• No Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms. We may assign them without notice.
• Force Majeure: We are not liable for delays caused by events beyond our control.
